Terms of Service

1. The Everthen service

Everthen lets you create personal letters, send them immediately, or schedule them for future delivery. Features may change over time as we maintain and improve the service. We may add, modify, suspend, or discontinue features when reasonably necessary.

2. Eligibility and accounts

You must be at least 13 years old to use Everthen. If you are not old enough to enter a binding agreement where you live, a parent or legal guardian must agree to these terms for you. You are responsible for the accuracy of your account information and for activity performed through your account.

Keep access to your Google account and Everthen session secure. Notify us promptly if you believe your account has been accessed without permission.

3. Your letters and recipients

You retain ownership of the letters and other content you create. You give Everthen a limited license to host, process, format, and deliver that content solely as needed to operate and improve the service.

You are responsible for your content, the recipient details you provide, and ensuring you have the right to send each letter. Do not send content that is unlawful, abusive, threatening, deceptive, invasive of privacy, infringing, or otherwise harmful.

4. Delivery and scheduling

We work to deliver letters at the time you select, but exact delivery is not guaranteed. Delivery can be delayed or prevented by incorrect recipient details, email-provider filtering, outages, network failures, legal requirements, or circumstances beyond our reasonable control.

Review recipient addresses, dates, times, and letter content before sending. Once a letter has been sent, Everthen may not be able to recall or remove it from the recipient’s inbox.

5. Acceptable use

You may not use Everthen to:

• Break the law, violate another person’s rights, or facilitate harmful conduct.
• Send spam, unsolicited marketing, malware, fraudulent messages, or impersonations.
• Harass, exploit, threaten, or expose another person’s private information.
• Interfere with the service, bypass security measures, or probe systems without permission.
• Use automated methods to overload, scrape, or misuse Everthen.

6. Everthen’s rights

Everthen and its licensors own the service, including its software, branding, visual design, and other materials, excluding content you create. These terms do not grant you rights to use Everthen’s trademarks or branding without permission.

7. Third-party services

Everthen relies on third-party providers for functions such as Google sign-in, hosting, data storage, and email delivery. Their services may be governed by separate terms and policies. We are not responsible for third-party services that we do not control.

8. Suspension and termination

You may stop using Everthen at any time. We may restrict or terminate access if you materially breach these terms, create risk or harm, or if required by law. When practical, we will provide notice and an opportunity to resolve the issue. Provisions that logically should survive termination will continue to apply.

9. Service disclaimer

Everthen is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the service will always be uninterrupted, error-free, or that every scheduled letter will be delivered at an exact time.

10. Limitation of liability

To the fullest extent permitted by law, Everthen will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from your use of the service. Nothing in these terms excludes liability that cannot legally be limited.

11. Privacy

Our Privacy Policy explains how we collect, use, and protect personal information when you use Everthen.

12. Changes to these terms

We may update these terms as Everthen evolves. We will post the revised terms here and update the date above. If a change is material, we will provide additional notice where required. Continuing to use Everthen after revised terms take effect means you accept them.

13. General terms

If part of these terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these terms without our permission. We may transfer them as part of a merger, acquisition, reorganization, or sale of assets.
